A Disclaimer

Hyperpub is a service operated by Hypersuade, LLC, a limited liability company taxed as an S-Corporation (“we,” “us,” or “the Company”). Hyperpub provides a collaborative storytelling and publishing service that transforms client input into professionally crafted manuscripts and published books. These policies protect both the client’s intellectual property and the intellectual property of Hypersuade, LLC, and ensure a fair, transparent, and legally compliant partnership.

Agreement To Terms & Eligibility

By accessing or using the Hyperpub website, services, intake forms, questionnaires, or any related materials (“Services”), you agree that:

  • You have read, understood, and agree to be bound by this Policy Document (the “Terms”).

  • If you do not agree, you must not use the Services.

  • Hypersuade, LLC may update these Terms from time to time. Continued use of the Services constitutes acceptance of updated Terms.

1.
Intellectual Property Policy

1.1 Client Ownership of Book Content
Client Story Ownership (Applies Immediately, Including the Free Chapter)
All ideas, stories, personal experiences, business frameworks, questionnaire responses, and any other content provided by the client (“Client Materials”) are and always remain the sole intellectual property of the client, regardless of whether the client purchases a paid service. Hypersuade, LLC does not claim any ownership over Client Materials and does not retain rights, royalties, usage claims, or reuse permissions.  The copyright of the book is assigned to the client.

1.2 Hypersuade, LLC’s Intellectual Property
Hypersuade, LLC retains ownership of:

  • Proprietary questionnaires, frameworks, editorial processes, and methodologies

  • The Hyperpub brand voice, archetypes, messaging, and manifesto

  • Internal templates, prompts, workflows, and trade secrets

  • All human- and AI-assisted creative processes used to produce manuscripts

 

Clients may not reuse, resell, or distribute Hypersuade, LLC proprietary materials outside their project.


1.3 AI-Assisted Creation Transparency
Hypersuade, LLC uses a blend of:

  • US-based human editors and storytellers

  • AI-assisted drafting tools

  • Proprietary narrative frameworks


Clients own all output. Hypersuade, LLC owns the process.
 

2.
Privacy

2.1 Client Privacy
Hypersuade, LLC treats all client-provided material—stories, questionnaires, personal details, drafts, and business data—as private.


Hypersuade, LLC will not:

  • Share client content

  • Use client content to train external AI models

  • Disclose client content publicly without written permission


2.2 AI Training Policy
Hypersuade, LLC will never upload, submit, or contribute client content to any third-party AI training dataset, model-training pipeline, or machine-learning corpus.


2.3 Optional Public Use Permission
Client content may only be used in marketing if the client explicitly grants written permission.
 

3.
Content Rights, Accuracy, & Truth–Narrative

3.1 Accuracy Responsibility
Hypersuade, LLC may introduce creative elements — including dialogue, atmosphere, weather, pacing, internal thoughts, and narrative embellishments — to craft a compelling story. These additions are narrative, not factual, unless the client designates them as factual.


Hypersuade, LLC will never create or include invented statements or scenes portraying real, identifiable individuals engaging in illegal, defamatory, harmful, or reputation-damaging behavior unless the client provides such information as true.


The client is solely responsible for:

  • Verifying all factual information (dates, names, events, financials, claims, etc.) in the manuscript 

  • Ensuring depictions of real individuals are accurate and not defamatory

  • Distinguishing factual content from narrative or symbolic content

  • Reviewing and approving the entire manuscript before publication


By approving the final manuscript, the client assumes full responsibility and legal liability for factual accuracy and all depictions of real individuals.


Hypersuade, LLC is not liable for any factual inaccuracies or legal issues arising from the client’s approval and publication, including inaccuracies introduced through narrative embellishment.

4.
Editorial Process & Revisions

Your manuscript isn't a one-shot delivery. This is a collaborative process, and we're committed to working with you through multiple rounds of revision to create the best version of your book.

4.1 What's Included in Your Revision Rounds
Each manuscript package includes up to three revision rounds. The following shows the scope of edits we can perform based on your requests:

  • Structural edits: Reorganize chapters, adjust pacing, refine the narrative arc

  • Voice and tone refinement: Ensure the writing sounds like you and matches your intended style

  • Content incorporation: Add new information, stories, or examples you provide

  • Editorial refinement: Enhance clarity, flow, and readability

  • Client feedback implementation: Make adjustments based on your notes and direction

  • Additions and clarifications: Expand sections, add context, or develop ideas further

  • Client writing integration: Incorporate passages you've written yourself if you want to contribute your own prose

 

4.2 Making the Revision Process Easy
When you receive your first draft, we'll also send you a comprehensive revision guide that walks you through how to review your manuscript effectively, what to look for, and how to communicate your feedback. This helps ensure the book captures what you want to say in a way that feels right to you.


Your revision requests can be as minor as adjusting a few sentences or as substantial as reshaping entire chapters. We're here to get it right.


Example Revision Request:
"Chapter 3 feels too formal. Can you make it more conversational, like I'm talking to a college friend over coffee? Also, I forgot to mention the partnership with DataCorp that changed our entire approach in 2019. Can we add a section about that? It should go right before the part about scaling the team. And I wrote out the story about the board meeting where we almost lost funding. I'm attaching it. Can you work that into Chapter 5 and make sure it matches the rest of the tone?"


This kind of feedback is exactly what the revision process is for. We'll make these changes and send you an updated manuscript.


4.3 What May Require Additional Fees:
We're committed to making all the changes you need to create your best book. The only revisions that may require additional fees are those involving:

  • Extensive new research beyond the information you've provided

  • New interviews or fact-checking requiring significant additional work

  • Substantial new content that significantly expands the scope beyond the original Story Profile

 

These situations are rare and are only in place to ensure fairness for clients acting in good faith. If we believe a revision request might require additional fees, we'll discuss it with you before proceeding.

4.4 Cover art revisions 
Hyperpub uses a structured cover design framework based on 10+ proven cover archetypes commonly used in business and non-fiction publishing. Clients select their preferred archetype through a guided questionnaire, which also captures color preferences, imagery requests, and design references.


Upon completion of the cover design questionnaire, Hyperpub will deliver 3-5 cover design options based on the selected archetype and customer specifications. All covers include front, back, and spine design formatted to Amazon KDP specifications.


If the initial 3-5 options do not meet the client’s needs, the customer may request an additional set of 3-5 options up to two (2) times. These requests may be for:

  • Alternative designs within the same archetype

  • Designs from a different archetype

 

Once a client selects a specific cover option to move forward with, up to two (2) revision rounds are included. Acceptable revisions include:

  • Color adjustments

  • Typography or font changes

  • Element repositioning or resizing

  • Contrast, spacing, or layout refinements

  • Text modifications (subtitle, tagline, back cover copy)

  • Minor imagery adjustments


All covers are designed to meet Amazon Kindle Direct Publishing technical requirements and are optimized for both thumbnail and full-size display. Covers are delivered in print-ready format.

5.
Publishing & Distribution

Hyperpub is not a publishing company. With our publishing service, we prepare your book manuscript and all necessary elements for publication through your own Amazon Kindle Direct Publishing (KDP) account.


5.1 Our Publishing Service Includes

  • Complete manuscript formatting for print and ebook

  • Custom cover design (front, back, spine)

  • Interior layout and design

  • ISBN assignment (you retain ownership)

  • Guided setup through video call(s)


5.2 The Amazon KDP Process
Through one or more video calls, we will guide you step-by-step through setting up your own Amazon KDP account. During these sessions, we will either walk you through the upload process or handle the uploading directly on your account (based on your comfort level and preference). We will ensure your book is properly configured, formatted, and ready for publication.


You will determine your book's pricing. Once published, your book will have its own Amazon listing and be available for purchase as both print and ebook (your choice). At any time you can also order author copies printed and shipped to you at cost (typically $2-$3 per book, regardless of your list price).


5.3 Banking and Payment Information
As part of the KDP setup, you will need to enter your bank account information directly into your Amazon KDP account so that book sale proceeds can be deposited to you. We will show you where to enter this information during our video calls, but at no point will we ask for, need, or have access to your banking information. All financial information stays between you and Amazon.


5.4 Ownership and Control
You retain full ownership and control of your book through your own KDP account.
All royalties are paid directly to the client.


Hypersuade, LLC does not collect a percentage of book sales.
 

6.
Payment & Refunds

6.1 Free Chapter

  • Delivered in approximately 72 business hours.

  • No credit card required.

  • All content provided for the free chapter remains the client’s IP.


Hypersuade, LLC will never reuse or repurpose client stories for other clients.


6.2 Manuscript Fee
Full payment is required upon ordering of the manuscript.

 

6.3 Publishing Fee

Full payment is required upon ordering of publishing services.


6.4 Refunds
Work already performed (writing, editing, design, publishing) is non-refundable.
 Partial refunds may be considered only if cancellation occurs before substantial work begins.

7.
Production Timeline

7.1 Free First Chapter

After submitting your Story Profile questionnaire, you will receive your free first chapter in approximately 72 business hours in normal circumstances. Business hours are Monday through Friday, excluding official U.S. holidays. If you submit your Story Profile on a Friday evening or during a holiday weekend, the 72-hour timeline begins the next business day.


7.2 Manuscript

If you purchase a manuscript package, you will receive your complete first draft within 7-21 business days after submitting your Story Profile questionnaire. Business days are Monday through Friday, excluding official U.S. holidays. Your manuscript will be delivered as a PDF document that includes a title page and table of contents.


7.3 Revision Window

You have 18 months from the date you receive your first draft to request all revisions and confirm project completion. We encourage you to take your time reviewing each draft thoroughly.


7.4 Project Completion

Your project is considered complete when either:

  • You send an email confirming the manuscript is complete and you're satisfied with the final version, OR

  • The third revision round has been delivered, OR

  • 18 months have passed since you received your first draft without requesting revisions or confirming completion.

 

You retain access to the most recent PDF version of your manuscript regardless of project completion status. After project completion, additional revision requests may be available for an additional fee.


7.5 Typical (non-binding) timelines

  • Free chapter: ~72 business hours

  • Manuscript: 6–8 weeks

  • Revisions: 1–3 weeks per round

  • Design & publishing: 1–2 weeks


These may change based on client responsiveness and project complexity

8.
Electronic Signatures & Communications

Electronic signatures, website checkbox submissions, digital agreements, and emailed confirmations are valid and enforceable.

Primary communication channels: Email, web portals/shared docs, scheduled calls


Hypersuade, LLC aims to respond within 24–48 business hours

9.
Termination

Either party may terminate the relationship if:

  • The client requests unethical or defamatory content

  • The client behaves abusively

  • The client violates policy

  • Circumstances prevent continued work

  • Refunds follow Section 6.

10.
Portfolio & Testimonials

Client permission is required for:

  • Displaying book covers

  • Sharing testimonials

  • Referencing the project publicly

  • Drafts, questionnaires, and private content are never shared.

11.
Contractors & Vendors

All work is work-for-hire belonging to Hypersuade, LLC until assigned to the client. Contractors may not reuse client content

12.
Updates

Hypersuade, LLC may update these Terms. Clients will be notified when updates materially affect ongoing projects.

13.
Website Use & Prohibited Conduct

Users may not:

  • Scrape or copy site content

  • Use bots or automated systems

  • Attempt to hack or disrupt the website

  • Upload malware

  • Use the site for illegal purposes


Hypersuade, LLC may restrict access for violations.

14.
DMCA Notice

Hypersuade, LLC respects copyright law.

 

Copyright complaints must include required DMCA information, including:

  • Your name and signature

  • Identification of the infringing work

  • Identification of infringing material

  • Contact information

  • A good-faith statement

  • A statement under penalty of perjury

15.
Indemnification

The client agrees to indemnify, defend, and hold Hypersuade, LLC harmless from claims arising from:

  • Client-provided content

  • Hyperpub developed content

  • Factual inaccuracies

  • Defamatory statements supplied or approved by the client

  • Violations of third-party rights

  • Breaches of these Terms

  • Publication or distribution of the manuscript

16.
Limitation of Liability

Hypersuade, LLC’s liability is limited to the lesser of:

  • The amount paid by the client in the preceding six (6) months, or

  • $5,000

  • Hypersuade, LLC is not liable for indirect, consequential, exemplary, or punitive damages.

17.
Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

18.
Arbitration

18.1 Mandatory 60-Day Informal Resolution Period
Before initiating arbitration, you agree to first attempt to resolve any Dispute informally by notifying Hypersuade, LLC in writing via the form at: hyperpub.co/contact

 

The notice must include:

  • Your name

  • Contact information

  • A detailed description of the issue

  • The specific relief you are requesting


You and Hypersuade, LLC agree to engage in good-faith negotiations for at least sixty (60) days before starting arbitration.


If the Dispute is not resolved within 60 days, either party may initiate arbitration.

18.2 Agreement to Arbitrate
If the parties cannot resolve the Dispute informally, the Dispute will be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, unless you are acting on behalf of a business entity, in which case the AAA Commercial Rules shall apply.


Arbitration shall be conducted in Collin County, Texas, unless both parties agree otherwise.


The arbitrator must apply Texas law.

18.3. Scope of Arbitration
This arbitration requirement only applies to Disputes directly arising from:

  • The Hyperpub service

  • Your use of the Hyperpub intake process

  • Payments or transactions with Hypersuade, LLC

  • Any written agreement between you and Hypersuade, LLC


The following types of disputes are NOT subject to arbitration:

  • Disputes relating to marketing content, website information, or advertising claims

  • Disputes unrelated to the Hyperpub service

  • Requests for injunctive or equitable relief

  • Claims concerning intellectual property rights

  • Claims eligible for small claims court, which either party may pursue instead of arbitration

 

18.4 Class Action Waiver
Arbitration must proceed solely on an individual basis.

  • No class arbitrations

  • No class actions

  • No representative actions

 

18.5 Limitations on Remedies and Damages
To the fullest extent permitted by law:

  • The arbitrator may not award punitive damages

  • The arbitrator may not award consequential, incidental, special, or exemplary damages

  • Damages are strictly limited to direct, actual damages

  • The arbitrator may not award damages exceeding the amount paid by you to Hypersuade, LLC for the Hyperpub service

  • Attorney’s fees may only be awarded where required by applicable law

 

18.6 Filing Deadline
Any claim must be filed within one (1) year after the event giving rise to the Dispute occurred.


Claims filed after one year are permanently barred.

18.7 Fees
Arbitration fees shall be allocated according to AAA Consumer Rules. Each party will bear its own attorneys’ fees unless applicable law requires otherwise.

18.8 Severability
If any portion of this Arbitration Agreement is found unenforceable:

  • The remainder stays in effect

  • If the class action waiver is found unenforceable, the entire arbitration requirement becomes void

 

18.9 Governing Law
This Arbitration Agreement is governed by the laws of the State of Texas, without regard to its conflict-of-law rules.
